Abstract: This paper examines the establishment and changes in the statute on “criminals exempted from banishment”in the Qing dynasty.In particular , the authors examines the problems exposed in adjudication of cases , and reveals meaning of the legal relationship between two principle parts in law : bannermen and common people and the significance of the adjusts of t his law.

摘要： 本文通过“犯罪免发遣”入律及例文的变化 ,尤其是诸多案例所暴露的问题 ,揭示清代社会两大法律主体———旗与民法律关系的调整及其意义。
